It stinks to high heaven, but unless the state can somehow make another appeal to the USSC fly, they are probably unlikely to try him.
Kenny would then become another of the exonerated, of which the death penalty supporters say there's no proof of innocence. Ho-hums was uttered already in 2005 about the case not being so weak as we would make it. The source being the would be prosecutor, that would eventually decide if to move forward and handle the case in a new trial.
Death and sickness of witnesses would leave handy exits, meaning the state would probably still proclaim they're in the right -- while all the same refrain from a new trial. That would in turn mean they wouldn't have to take responsibility for putting an innocent on death row for two decades -- neither morally nor economically. To me, that is corruption.
Kenny's freedom is the most important thing, freedom that didn't cost him his self-esteem. But it is really shameful that if and when he is released. it will be with a broken health, and most likely dirt-poor with no hope of restitution. Good bye and good riddance, thanks for the 20+ years we took.
I would for once like to see the state authorities showing some moral backbone and try the case fairly, or if not proclaim unequivocally that they were in the wrong. It might give them all kinds of problems, but it would be the Right Thing To Do. Then Kenny could sue for some compensation and at least have a more reasonable start of the rest of his life.
But I'm dreaming. Every time I get a reason to reevaluate some of my preconceptions, it makes me that much younger and more vital. |
Same with Bob and Randy.
Randy was aquitted through his recent re-trial. The prosecutor's then dismissed all charges against Bob, but IT STILL DOESN'T MEAN THAT THEY ARE INNOCENT according to the courts/judicial system.
So now we have had to file a "claim for innocence" and then go through ANOTHER trial to prove their innocence.
Then, and only then, will they be able to go to the "court of claims" for compensation.
It's a 50/50 chance. No guarantees. No promises that they will ever get one red cent for all that they have been through after 16-1/2 yrs of wrongful incarceration.
But as Bob has so eloquently put it, "There is NO PRICE on freedom."
If the money comes, which could be a 2-3 yr fight with the county/state, GREAT. If not, we are grateful to God for the miracle that they are both FREE, in GOOD health and being loved. http://www.freebobandrandy.com |
Talk about a system set up for appearances only.
Politicians can point at the system providing compensation for wrongful incarceration, but in reality the hoops to jump are such that most will remain without compensation. The alternative would probably wake up a few journalists, as the actual amount of ppl wronged becomes apparent. Every time I get a reason to reevaluate some of my preconceptions, it makes me that much younger and more vital. |
