Ohio death row inmate wins new sentencing trial

In Cincinnati, a federal appeals court has thrown out the death sentence
of a man convicted of kidnapping a Cleveland woman, beating her to death
and dumping her body in a junkyard.



 

Monday's ruling from the court in Cincinnati means the penalty phase of
Reginald Jells' trial will be redone. Jells was convicted of aggravated
murder in 1987.

In a split decision, a panel of the 6th U.S. Circuit Court of Appeals held
that Jells had ineffective legal counsel and that prosecutors withheld
certain evidence that could have been favorable to his defense.

After Jells waived a jury trial, he was found guilty by a 3-judge panel,
which also imposed the death penalty. The death sentence was upheld by
state appeals courts.
