The Texas Board of Pardons and Paroles has ruled to reinstate Martin's parole and he should be back home today. Here's some info from Joy, his fiancee as well as the article from the Houston Chronicle:
Sometimes we get good news!!!!! And I don't doubt for a moment that having all Martins supporters at the jail, even though they did not allow us in Martins hearing, made a definite impression on everyone concerned.
Martin was not alone and they know that he has supporters, friends and people who care about what happens to him. thanks to everyone who took off work to be with Martin at the hearing. He didn't see us but everyone in the small-town, small-minded jail sure saw us and knew why we were there.
let's struggle on until we abolish the death penalty forever!
(See Ward's web page to get information about Michael Johnson--www.adelante.com.) another likely innocent man that Texas wants to execute. Damn this state!
Gloria
Dear Gloria,
Jim and I just got in from visiting with Mr. McCloud in Huntsville and resigning all the parole papers for Martin. They are going to keep McKee as his parole officer, but Mr. McCloud will be the liason (don't know what good that is, but he knows where we stand). Jim explained that all the meetings, etc., will be video taped and there will be no more slip ups. Jim told McCloud repeatedly that McKee lied and it will all be recorded from here on out. Martin should be released today or tomorrow. They are waiting on a GPS monitor to arrive, but will have to release him to "lockdown" here at the house, without the monitor, if it doesn't come in, quickly. Thanks for all of your help, we should see Martin, soon. I have a "special show" for Michael Johnson this evening from 7-9 pm on KDOL. Love and blessings,
Joy

Former death row inmate will remain free

A former death row inmate who faced a possible return to prison after being accused of violating conditions of his release will be allowed to remain
free under supervision, state officials decided.
The Texas Board of Pardons and Paroles concluded Friday that Martin Allen Draughon should again be released with no changes to his restrictions.
Draughon, 43, was released in August after his capital murder conviction was overturned and he accepted a plea deal.
"That's great," Joy Weathers, his fiancee, said Tuesday. "We can get started all over again."
Draughon remained in the Polk County Jail late Tuesday but was expected to be released soon. He had been out of prison for about three weeks when he was arrested Sept. 12, accused of violating his restrictions.
Officials said Draughon had stopped at a fast-food restaurant without approval and did not stay in contact with the global positioning system which electronically monitors him.
Among the factors the board considers in such a case is the fact that this was a first offense, said Michelle Lyons, spokeswoman for the Texas
Department of Criminal Justice. "It will be looked at as a learning experience," she said.
Draughon must wear a GPS device, meet with a parole officer nine times a month and have his movements approved a week in advance. He was released to live in Livingston at the home of Jim Wolfe.
Draughon was s! ent to d eath row for the 1986 killing of Armando Guerrero after a botched restaurant robbery in Houston. U.S. District Judge Lee Rosenthal threw out the conviction in September 2004, declaring that evidence in an appeal showed Guerrero was killed by a bullet that had ricocheted.
Instead of retrying Draughon, Harris County District Attorney Chuck Rosenthal said he accepted a guilty plea for murder because ballistics evidence indicated that the bullet was not fired at Guerrero.
The agreement called for Draughon to serve 40 years. He already had servedenough time - 19 years and nine months on death row - to be released under the law, Lyons said.
