Below is a link to our newest motion for Patrick Swiney's case of actual innocence. It was filed in the 11th Circuit Court in Atlanta, GA on February 6, 2007. We think it is a "Masterpiece" (and it's an easy read), and we look forward to seeing what this court's reaction is.

An Update on Patrick's case

We had another setback from Judge Blackburn yesterday.  She denied our notice of appeal "As To Right" as to a matter of law, rather than as to Patrick's case.  What she did was "construe" the notice of appeal to be a Certificate of Appealability which is required if we argue Patrick's case.

The following information was gathered tonight from Lexis-Nexis News Wires database and is copied verbatim below.

Note that Hendrix was prosecutor for 22 years; he was convicted in 1983, others were convicted in 1981. Since investigations normally precede convictions by some time and several were convicted in this sting operation its entirely feasible that other investigators (Swiney) were involved between 1973 and 1977.

Introduction to Patrick Swiney's case

On the night of December 10, 1987, Betty Snow Swiney and Ronald Pate were shot to death in the home of Betty and Patrick Swiney.

Patrick and Betty had been married just five months.

The marriage was in trouble from the start. Betty was addicted to drugs and both where drinking too much.

Patrick's weakness was that he drank too many Budweiser's. He could sip a glass of Blue Nun and not go overboard, but he couldn't do that with Budweiser Beer. He classifies that as alcoholic, and he says that at least -- in that respect -- prison saved his life. He was a quiet drunk, if you will. Preferred to go off by himself and think about things, rather than Party and get rowdy. Betty was vivacious and fun-loving, so this must have attributed to some of the arguments. When they were sober, everything was fine. Patrick describes Betty as very sweet when she was sober.
