Court could make state retry Richey in 90 days or free him

COLUMBUS - The U.S. 6th Circuit Court of Appeals could start the 90-day clock ticking any day now for prosecutors to retry Kenneth Richey for murder or set him free.

KENNY Richey, the Scot who has been under a death sentence in America for 18 years, must be freed or retried by 25 August, it emerged last night.

A Scot on death row in the US was today told that an Appeal Court decision to quash his conviction cannot be set aside.
The ruling means that Kenny Richey, 40, who has been facing execution for 18 years, must now be retried within 90 days of May 25 or set free from death row.
The 6th Circuit have agreed that the 90 days to retry or free Kenny should begin on 25th May 2005.
We await the State's response to this also. With any luck Kenny will be home late August. :)

I have just returned from Ohio, after visiting Kenny which coincided with the latest news that the 6th Circuit Court of Appeals had denied the State's request for a rehearing.
