Death Row Scot Kenny Richey is facing at least another TWO years behind bars before he learns his fate.
And if he is freed, his lawyer fears he won't get a PENNY in compensation for his 20 year fight for justice.
Richey, 42 has been facing death by lethal injection since his 1987 conviction for starting the blaze which killed a young girl in Ohio.
Judges ordered a retrial in 2005, but now the Edinburgh born, dad of one has been told to expect massive delays as legal eagles re examine the evidence.
The ruling from America's Supreme Court means angry Richey must continue to kick his heels at Mansfield Correctional Institution in Ohio.
Last night his Boston based brief, Ken Parsigian, said, "I've told him that it's going to take longer than we thought. It's been really horrible- an immediate decision would be better, rather than keeping him hanging on like this.
"The courts have dragged this out far too long and it's really taken it's toll on Kenny's health. He has a heart condition and his emotions are constantly tugged."
Richey has always denied starting the apartment block fire that killed two year old Cynthia Collins in 1986.
Ken added, "We have scientific proof that will confirm beyond reasonable doubt that he is innocent. Our experts are ready to give evidence that will secure him a not guilty verdict."
But he added that Richey won't get ANY cash if he is freed.
He added, "Because of the way the law is written in the USA, he won't be able to claim compensation for his years in prison"
"It will be impossible to secure him any sort of financial support when he is released.
It will be extrememly hard for him to find a job or try to build his life but he is hopeful that he will be able to return to the UK".
