Richey’s legal team files motions

OTTAWA - Kenneth Richey's legal team asked prosecutors Friday to give them an account of what they intend to prove at trial, and they want money to hire an investigator and an expert witness.

 

 

Richey’s legal team filed the request and motions in Putnam County Common Pleas Court. They want money, but did not specify how much, to hire an investigator and a mitigation expert. The mitigation expert is used only if Richey was convicted on death penalty charges and his case proceeded to the penalty phase.

Richey’s team also filed a motion requesting access to him while he is in the Putnam County jail.

Richey is waiting for his retrial, scheduled for Nov. 26 but will likely be next year. He is accused of killing 2-year-old Cynthia Collins in a June 30, 1986, apartment fire in Columbus Grove. Prosecutors allege he was out to get his girlfriend when the young girl was killed.

At his first trial, Richey was convicted of aggravated murder, aggravated arson, child endangering, and breaking and entering. A three-judge panel sentenced him to death. He spent more than 20 years on death row before he was awarded a new trial after a federal court ruled he didn’t receive adequate legal representation at his trial.
