For Kenny Richey, the innocent Scot on Death Row, the only reason to look forward to another Christmas day in Mansfield Correctional Institution in Ohio, is the knowledge, that for now, no date for his state sponsored death has been announced.
The living hell of knowing how you are to be executed, despite your innocence of a crime that was never committed, is a cruel and de-humanising distortion of justice.The preservation of reputations, legal and political, of those involved in the prosecution and disposition of the case against Kenny Richey, can now be seen clearly as being of more importance than the wrongful execution of an innocent man. How will these people approach Christmas? Possibly with relief that their reputations are being protected. How do those who stood by and let a miscarriage of justice take place without questioning the irregular investigation of an alleged crime of murder by arson, excuse themselves from culpability ?
Why, in the name of justice, was the inept performance of an inexperienced defence attorney allowed to be of more assistance, by dint of his incompetence, to the prosecution than to his client?
Did the prosecution really believe that they convinced the three judge panel of the accused man's guilt, beyond reasonable doubt.
Forensic evidence exists that proves arson was not involved in the death of two year old Cynthia Collins.To establish her death as murder in the circumstances, arson has to be proven as the cause.
In the absence of such proof, the charge of murder evaporates.
The tragic death of Cynthia Collins was cynically used by assistant prosecutor Randall Basinger to aid his political ambitions, and his handling of the prosecution case and that of the defence attorney, Bill Kluge, rendered Kenny Richey a sitting duck. It is long past time for the truth to be known, but the state of Ohio , "the state that NEVER gets it wrong" will need to accept that its officials, legal and political do suffer the human frailty of fallability.The truth is, justice supercede's that of the state sanctioned slaughter of an innocent man.
