After Kenny's hearing. So now what?

Media and supporters alike are calling me or emailing me asking "So what happens now in Kenny's case?"

I have tried to explain to people that this hearing will have no instant answers for Kenny and his case.

Some reports have been pretty accurate, others have been downright absurd.

Reports that Kenny could be freed on bail in around 12 weeks, are NOT true. It takes the court several months to come to a decision. While the last time took a long time, we are expecting a decision in three to four months. However, just because this is what we expect, doesnt mean it will happen then. It will happen in the courts time not ours. So we wait once more.

Even if the decision is the same as last time, which was that the State were ordered to either retry Kenny or free him within 90 days, we now know this is not exactly true. The State would appeal once more and it will appeal right to the US Supreme Court once again, which is more courts to go through and more time Kenny has to be on death row.

I know it is unfair but thats the way it is sadly.

At a defendants trial, where the State has to prove its case beyond a reasonable doubt, the odds are stacked in favour of the defendant, but that once there is a conviction, the odds shift heavily in favour of the State. No matter how much evidence there is of innocence.

IF Kenny gets a new trial, the odds will shift heavily back in his favour because the State will again have to prove its case beyond a reasonable doubt. It will have to do so with Kenny having a real defence team, with real experts, unlike in his original trial. I am extremely confident we'd win a retrial. Getting past the 6th Circuit and the Supreme Court, however, will be much tougher.

So as you see there is no "instant" fix. Its going to take time and that is something we are used to.
