John Spirko

Spirko - a case like a house of cards

John Spirko

John Spirko has the not so pleasurable distinction to be one of the longest serving inmates on Ohio's Death Row with more than 20 years.

His story begins in August of 1982 when the Elgin Postmistress, Betty Jane Mottinger was abducted. Spirko himself was out on Parole after having served 13 years for a murder in Kentucky. He got involved in a barroom brawl and was charged with parole violation.

He asked his girlfriend at the time - LuAnn - to smuggle in some hacksaw blades to help him escape, which she did. He attempted to escape, which he failed, but he hurt a couple of officers in his attempt.

Sick of the fact that he had gotten LuAnn into trouble, and watching TV reports about the Mottinger Case he got the idea to try using that case as leverage to get her out of trouble. Spirko speedily became the number one suspect in the case, never mind that all the things he told the FBI was such as had already been told on TV. Nevermind that he himself had been 120 miles from the scene.

For nearly 24 years, John Spirko has lived on Ohio's death row... until last week.

Governor Ted Strickland commuted John Spirko's scheduled date with death slated for one week from today.
But he didn't free Spirko, who is convicted in the 1982 kidnapping and murder of Elgin, Ohio postmistress Betty Jane Mottinger, the woman who ran Elgin's post office. John Spirko's new prison address is now Toledo -- his hometown.

Jerry Anderson interviewed him this week for a News 11 exclusive report.

Statement of Spirko's attorneys

Friday, 11 January 2008

John Spirko is an innocent man who has spent 25 very long and hard years in prison -- 23 on death row -- for a crime he did not commit. There can be no joy in the commutation of an innocent man's sentence to life without parole. The positive thing about Governor Strickland's commutation is that the State will now not execute an innocent man and that we can, and will, continue to fight for Mr. Spirko's complete exoneration and release.
